Definitions –

1.1 Contractor: The ‘contractor’ is Charles James BPM Ltd.

1.2 Client: The ‘client’ is a person or entity seeking goods and/or services from the contractor.

1.3 Quotation/Estimate: A quotation/estimate is a formal offer made by the contractor to the client within a hard copy or electronic document, headed with the title ‘Quotation or Estimate’, no other document is intended to be an offer and is not recognised or may be relied upon as such. A quotation/estimate price may alter if unforeseen circumstances arise which lead to greater costs being incurred by the contractor.
Any verbal estimate given to the client by Charles James BPM Ltd will always be supported by a written quotation or estimate.

Charles James BPM Ltd will provide all customers with a written quotation/estimate, which will include sufficient detail for the completion of the works. If any clarification is required, please contact us so that we can provide it. Extra works can be provided and added subject to a written confirmation including cost.

A ‘contract’ with Charles James BPM Ltd is an agreement by the client to have work undertaken based on a written quotation headed ‘Quote/Estimate’ submitted directly to the client and is a clear and straightforward undertaking between the two parties to form a contract.

Accepting a written quotation, estimate or estimation from Charles James BPM Ltd and agreeing to the commencement of works will allow these terms and conditions to come into effect. By way of a verbal or written confirmation for products, goods and or services [with or without an accompanying deposit payment], the client enters a contract with Charles James BPM Ltd.

All prices quoted are calculated based on free access and unimpeded working during our normal working hours (8am – 5pm Mon – Fri, excluding Bank holidays), unless otherwise agreed. Please note if we require to work onsite outside of these hours, we will obtain prior permission.

Free access is required for delivery of building materials, plant, machinery and skips etc.

Charles James BPM Ltd will agree all practical arrangements with regards to working methods with the client to provide minimum disruption to the client and allow work to be carried out efficiently.

All used or removed materials on-site remain the property of Charles James BPM Ltd and will be disposed of accordingly.

Charles James BPM Ltd may directly employ or sub contract labour or specialist providers to work on site. Each sub-contractor takes full responsibility for their own third-party liability. Plumbing sub-contracts are CORGI registered. Electricians are Part P certified. Charles James BPM Ltd will oversee all works to completion and takes full general and operational responsibility in the running of any contract agreed with the client.

Charles James BPM Ltd will provide a payment plan to the client prior to commencement of works. This will usually include a deposit, staged payments, and an end payment upon completion of works. Deposits are non-refundable and allow Charles James BPM Ltd to book work in and agree a formal start date for works and purchase materials. Please note, in the very unlikely event that Charles James BPM Ltd must cancel your work, your deposit will be fully refunded.

Invoices will be sent out prior to the relevant payment date and each invoice will serve as a receipt for payment. Payments must be made in a timely manner or work progress may be impeded or ceased (in the case of non-payment). Payments can be made by bank transfer only. All invoices include our bank details for bank transfers. If the invoice is not paid despite reminders, we reserve the right to take legal action.

Insurance – Public Liability and Employers’ Liability: Charles James BPM Ltd has Public Liability Insurance to the sum of £2,000,000 and Employers’ Liability to the sum of £10,000,000. All usual general building practices are covered within our insurance policy.

All client information is retained in accordance with the Data Protection Act 2018 and all personal and other client details will remain confidential.

In the event of unforeseen difficulties arising, or any other circumstantial changes, the quotation price or estimated cost may be revised to reflect the situation at hand before or after commencement of work.

Guarantees: All customers will benefit from a full guarantee on our workmanship for a period of 12 months, the guarantee covers new build work only and does not apply to repair work, renovations, restorations, refurbishments, and alterations carried out unless agreed in writing before the start of any contract. Repairs to buildings, roofs, infrastructure or any existing workmanship or related materials are not covered by our guarantee. Guarantees on materials run in accordance with manufacturer's warranty periods where applicable. Our guarantee covers all new work and new materials used in construction but does not guarantee the integrity of any existing structures, materials or decorations. New build structures only (roofs, flashings to new roofs and new vertical brickwork joints to existing masonry) are covered by our guarantee against water ingress, ingress of water through existing structures are not covered by this guarantee. Subsidence issues (sinkage below slabs, subsidence below new or existing foundations or movement of foundations or floors etc) are not covered within our guarantee agreement. In the event of a failure beyond the guarantee period we will be happy to investigate the cause and negotiate a solution to the problem without delay (if it is found that our company is wholly responsible for the failure) and carry out any agreed repairs as soon as possible. Charges may apply for remedial work carried out beyond guarantee dates or to items not covered by our guarantee. Decorations are signed off on completion and not covered by a guarantee policy.

No responsibility is taken by the contractor for the presence of perished, infested or rotten timber (or any other perished, rusty, infested or rotten materials) in existing structures such as doors, constructional or other timbers, windows and frames whether detected or undetected at the time of contract.

Charles James BPM Ltd will endeavour to protect existing surfaces with the use of dustsheets and loose plastic sheeting etc along with care in our working practice. However, responsibility for protection from damage of any existing surface or fabrics etc is the responsibility of the client. Arrangement can be made to put in place protection of existing surfaces, over and above our basic cover, at a negotiated additional cost. We strongly recommend the clients moves any expensive or sentimental items before work commences. If we are required to move furniture to undertake our work, we will not be held responsible for any breakages or stains that may occur. We advise clients to keep all valuables and expensive items safe and secure for the duration of the works, as we cannot be held liable for any theft or loss.

Building Control: Inspections and other related issues concerning the Local Authority Building Control Department can be managed by Charles James BPM Ltd if requested by the client in advance and details of these arrangements are confirmed in writing by both parties. Payment on completion of a contract is not reliant upon presentation of Building Control Completion Certificates as delays are sometimes possible due to Local Authority administration issues.

Further to the request for a quotation or estimate from a client, we will in turn make a request for the customer’s design requirements i.e. architectural or other design, product requirements, style, proportions, measurements, required materials [whether they match an existing design or otherwise] and any other requirements of design such specification and texture of textiles, locking, latching, fastening, bolting mechanisms etc of windows, doors hatches and roof lights, colour, finish, glazing styles and glazing specifications details of floor and carpet design, paint and varnish specifications and all other aspects of design. The client shall be entirely responsible for their own design requirements and design specification in terms of performance, workability and fitness for purpose. Charles James BPM Ltd can assist in the process of design, by sharing advice and expertise, on the understanding that our company will bear no responsibility for the workability, fitness for purpose or any other outcome or eventuality concerning the end design.

Contract duration: An approximate duration time for work to be carried out can be found on our quotations. The 'Contract duration' is to be used as a guide only and will not affect the agreed contract price i.e. if a contract takes longer than expected, no extra charges will be levied unless previously agreed and conversely if good progress is made and a contract takes less time to complete than expected, the client should not expect to receive a discount.

Charles James BPM Ltd reserves the right to terminate an agreed contract if the client is in breach of these terms and conditions.

We will endeavour to always employ a helpful and professional attitude and will always attempt to bring the building works to a satisfactory conclusion as soon as possible considering weather conditions, availability of specialist materials and unforeseen circumstances etc.

Charles James BPM Ltd take pictures of the progress of our projects. We reserve the right to use these pictures in our portfolio of work, on our website and on various social media websites for marketing and information purposes. Please let us know via email at the start of the project if you do not consent to this.
